Terms of Service

1. These terms

By requesting a quote or booking a shipment with First Choice Logistics, you agree to these terms. Where a signed service agreement exists between us, that agreement takes precedence over anything here.

2. Quotes

Quotes are valid for the period stated on them and are based on the information you give us. If the actual cargo differs materially from what was described — weight, dimensions, or condition — the price may change. We will tell you before proceeding, not after.

3. Your responsibilities

• Provide accurate cargo, ownership and destination information.
• Supply valid documentation — for vehicles, including clear title.
• Confirm any vehicle shipped is free of undisclosed lien, loan or lease.
• Remove personal belongings unless we have agreed otherwise in writing.
• Declare any hazardous materials, including lithium-ion batteries.

4. Liens and finance

We screen vehicles for active liens before shipping. Shipping a financed or leased vehicle without the lienholder's consent may be unlawful and can result in the vehicle being seized. If an undisclosed lien is discovered, we may refuse or halt the shipment, and you remain responsible for costs already incurred.

5. Transit times

All transit times are estimates supplied by the carrier. Weather, port congestion, customs inspections and vessel scheduling are outside our control. We are not liable for losses arising from delay.

6. Payment

Payment terms are set out on your invoice. Cargo will not be released at destination until all charges are settled. Overdue accounts may incur storage and demurrage charges levied by the port or carrier, which are passed through at cost.

7. Insurance and liability

Standard carrier liability applies by default and is limited — typically far below the value of the cargo. We strongly recommend all-risk marine cargo insurance, which we can arrange. Our own liability is limited to the freight charges paid for the affected shipment, except where liability cannot be limited by law.

8. Cancellation

Cancellation before loading may incur administrative and carrier charges already committed. Once a container is loaded and a bill of lading issued, cancellation is generally not possible.

9. Prohibited cargo

We do not ship undeclared hazardous materials, weapons, narcotics, or goods subject to sanctions or export restrictions. You are responsible for ensuring your shipment is lawful at both origin and destination.

10. Governing law

These terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.
